General Terms and Conditions

§ 1 Scope

These General Terms and Conditions (GTC) apply to all contracts concluded via the online shop at www.luftpiraten.eu between the provider and the customer.

Deviating, conflicting or supplementary general terms and conditions of the customer do not become part of the contract unless their validity is expressly agreed to in writing.

§ 3 Formation of contract

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to submit an offer (invitatio ad offerendum).

By clicking the "Order with obligation to pay" button in Stripe Checkout, the customer submits a binding offer to purchase the products in the shopping cart. The contract is concluded upon payment confirmation by Stripe and the dispatch of an order confirmation email by the Provider.

The Provider reserves the right to reject orders without stating reasons.

§ 4 Prices and VAT

All prices stated are final prices in Euro (EUR). Pursuant to § 19 UStG (German VAT Act – small business exemption), no VAT is charged or shown.

§ 5 Shipping costs

Shipping costs are charged in addition to the product price. The exact shipping costs are displayed during the checkout process before the order is completed.

Delivery is made exclusively to Germany and other EU member states. Different flat-rate shipping charges apply for deliveries to Germany and other EU countries; these are shown at checkout.

§ 6 Payment methods

Payment is processed exclusively via the payment service provider Stripe. The following payment methods are available:

  • Credit card (Visa, Mastercard, American Express)
  • PayPal
  • Klarna (instalment purchase / instant payment)

Payment is due immediately upon completion of the order.

§ 7 Delivery

Shipment is made exclusively to Germany and EU member states. Deliveries outside the EU are excluded.

Delivery time is generally 3–7 working days after receipt of payment, unless a different delivery time is stated for the individual product.

If an ordered product is unavailable, the Provider will inform the customer immediately and promptly refund any payment already made.

§ 8 Retention of title

The delivered goods remain the property of the Provider until the purchase price has been paid in full.

§ 9 Right of withdrawal

Consumers are entitled to a statutory right of withdrawal. Details are set out in the withdrawal policy available at www.luftpiraten.eu/en/widerruf.

§ 10 Warranty

The statutory warranty rights apply. The warranty period is two years from delivery of the goods.

For used goods, the warranty period may be reduced to one year by individual agreement. Any such agreement will be expressly stated in the product description.

§ 11 Limitation of liability

The Provider is liable without limitation for damages resulting from injury to life, body or health, for damages caused intentionally or by gross negligence, and in cases of mandatory statutory liability.

Any further liability of the Provider is excluded.

§ 12 Dispute resolution

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr/

The Provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

§ 13 Applicable law and jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The place of jurisdiction for all disputes arising from contracts with merchants, legal entities under public law or special funds under public law is Munich.
